- When and how IP litigation strategies can overstep the mark – How far can you push what is ‘allowed’ under the trade mark act and where will the court draw the line on that behaviour?
- Where are we now in relation to copycat behaviour – How much can you expect to rely on passing off?
- How not to lose the easy cases – The importance of evidence.

How the most recent case law affects the shaping of brand management and brand protection strategies in the luxury sector

The pathological phase of litigation, besides giving Courts the occasion to trace and refine valuable legal principles, offer brands new insights on how to manage and protect their IP assets and products. The panel will explore some of the latest landmark cases of trademark infringement, unfair competition, counterfeiting and misleading advertising, from different jurisdictions worldwide. Through such an overview, the session will cover the following:
- Practical issues for addressing and re-shaping fundamental business strategies: from the safeguard of shapes, sounds and well-known trademarks, to the definition and protection of the brand’s identity and reputation.
- The use of indications of origin – with particular reference to “Made in Italy” and the message of quality and prestige it conveys.
- Upcycling growth
- Reselling of luxury fashion items
- Counterfeiting and the problems often arising from illicit trademarks use in the secondary market
